1. Adult-Use Website and Age Requirement

Dirty Penny products are intended strictly for adults aged 21 years or older.

By using this website or purchasing from Dirty Penny, you represent and warrant that:

1. You are at least 21 years old;
2. You are legally permitted to purchase, possess, receive, and use the products offered on this website in your jurisdiction;
3. Any information you provide to Dirty Penny is accurate, complete, current, and not misleading;

Where Dirty Penny sells, distributes, ships, offers, or otherwise makes available hemp or hemp extract products intended for human consumption in Florida, Dirty Penny will do so only through properly permitted and compliant channels, including applicable Florida Department of Agriculture and Consumer Services (“FDACS”) Hemp Food Establishment food permit requirements.

Online sellers of hemp extract products intended for human consumption may be required to hold a valid FDACS food permit even where no physical inventory is maintained at a Florida address.

Dirty Penny reserves the right to restrict or suspend online sales, delivery, or shipment of any hemp extract product if required permitting, approved-source documentation, inspection documentation, supplier documentation, labeling, packaging, testing, or other compliance requirements cannot be satisfied.

Dirty Penny reserves the right to refuse, suspend, cancel, modify, or restrict any order where we determine that a product, customer, delivery location, payment method, age-verification result, supplier document, certificate of analysis, packaging, label, or advertising claim presents legal, regulatory, operational, or compliance risk.

3. Product Classification and Changing Hemp Laws

Dirty Penny may offer products containing or related to hemp, hemp extract, CBD, cannabinoids, hemp-derived THC, Delta-9 THC, terpenes, botanical ingredients, THC beverages, pre-rolls, flower, edibles, inhalable products, accessories, or other adult-use goods.

Unless expressly stated otherwise, products offered by Dirty Penny are intended to be lawful hemp-derived products or lawful adult-use accessories, and are not offered as unlawful marijuana products.

Dirty Penny does not represent that every product is legal in every state, county, municipality, territory, tribal jurisdiction, or delivery location.

Florida law already imposes hemp extract compliance standards separate from federal law. Under Florida Rule 5K-4.034, hemp or hemp extract intended for human consumption may not contain a Total delta-9 tetrahydrocannabinol concentration of more than 0.3%, with that concentration calculated as delta-9 THC plus 0.877 multiplied by delta-9 tetrahydrocannabinolic acid.

This Florida requirement is currently in effect and is separate from the federal hemp-law changes scheduled for 2026.

In plain terms, this means that THCA content is factored into the total THC calculation, and products with elevated THCA levels may not meet Florida’s hemp standard even if delta-9 THC alone is under the limit.

Federal hemp law is also changing. H.R. 5371, the Continuing Appropriations, Agriculture, Legislative Branch, Military Construction and Veterans Affairs, and Extensions Act, 2026, amends the federal hemp framework effective 365 days after enactment.

These amendments include total tetrahydrocannabinol standards and restrictions on certain intermediate and final hemp-derived cannabinoid products, including final hemp-derived cannabinoid products containing more than 0.4 milligrams combined total per container of total tetrahydrocannabinols and other cannabinoids with similar or marketed-as-similar effects to THC.

Customers are advised that federal law effective in November 2026 may significantly change the legal status of certain intoxicating hemp-derived cannabinoid products, including products containing Delta-8 THC, Delta-9 THC, THCA, HHC, converted cannabinoids, synthetic cannabinoids, or other cannabinoids with similar or marketed-as-similar effects to THC.

Dirty Penny reserves the right to discontinue, reformulate, remove, relabel, restrict, withhold, cancel, refuse, or suspend the sale or shipment of any product at any time in order to maintain compliance with federal law, Florida law, state law, local law, carrier rules, payment-processor rules, supplier requirements, insurance requirements, or risk-management policies.

You are solely responsible for understanding and complying with the laws applicable to your purchase, possession, use, transportation, and receipt of any product ordered from Dirty Penny.

4. Not a Medical Marijuana Treatment Center

Dirty Penny is not a physician, medical provider, pharmacy, or Florida Medical Marijuana Treatment Center unless expressly stated and lawfully licensed as such.

Nothing on this website should be interpreted as:

9. Cannabinoid labeling;
10. Serving-size information;
11. QR codes or scannable access to required product information and certificates of analysis;
12. Child-resistant packaging;
13. Packaging that is not attractive to children;
14. Restrictions on prohibited contaminants;
15. Restrictions on prohibited additives and color additives;

11. Product Availability and Order Acceptance

All products are subject to availability and compliance review.

Dirty Penny reserves the right to limit, reject, hold, cancel, refund, modify, or refuse any order at any time for any reason, including but not limited to:

2. Identity-verification failure;
3. Billing or payment concerns;
4. Suspected fraud;

We do not guarantee that every product can be shipped to every location.

Hemp-derived THC products, including THC beverages, Delta-9 products, flower, pre-rolls, and edibles, may be shipped outside Florida only where legally permitted and only after Dirty Penny determines that the destination, product type, carrier, age-verification process, and compliance requirements are acceptable.

Some products may be available only in Florida. Some products may be unavailable for delivery or shipment to particular states or jurisdictions.

Adult signature and age verification are required for hemp, THC, vape, and other age-restricted orders unless Dirty Penny expressly states otherwise.

Dirty Penny reserves the right to immediately restrict, suspend, or terminate shipping of any product category if federal law, Florida law, state law, local law, carrier rules, payment-processor rules, or supplier requirements change.

Federal and state hemp laws are subject to significant change in 2026. Product availability, shipping eligibility, and product categories may be modified, restricted, or discontinued to reflect legal updates.

14. No International Shipping

Unless expressly stated at checkout, Dirty Penny does not ship hemp, CBD, THC, vape, inhalable, cannabis-related, or restricted adult-use products internationally.

Dirty Penny also reserves the right to refuse orders to APO, FPO, DPO, freight-forwarding, mail-forwarding, hotel, temporary, commercial, or high-risk addresses.

15. Delivery, Adult Signature, and Risk of Loss

Shipping and delivery estimates are not guarantees.

Delays may occur due to carrier issues, weather, age verification, address issues, compliance review, payment review, product availability, legal restrictions, or circumstances outside Dirty Penny’s control.

You are responsible for providing a correct, secure, and deliverable address.

Adult signature is required for hemp, THC, vape, and other age-restricted orders unless Dirty Penny expressly states otherwise.

Where adult signature, AgeChecker verification, identity verification, ID verification, or restricted delivery is required, failure to complete delivery requirements may result in return, cancellation, restocking fees, shipping charges, non-refundable carrier fees, or refusal of future orders.

Dirty Penny is not responsible for delays, failed deliveries, refused deliveries, stolen packages, incorrect addresses, carrier errors, returned packages, or inability to complete age-restricted delivery where the issue is outside Dirty Penny’s reasonable control.

16. Vape, ENDS, and Inhalable Product Compliance

If Dirty Penny offers vape, vaporizer, e-cigarette, electronic nicotine delivery system, hemp vape, cannabinoid vape, disposable vape, cartridge, pod, component, liquid, part, accessory, or other inhalable product, additional restrictions apply.

Vape and electronic nicotine delivery system products are subject to federal, state, local, carrier, tax, registration, reporting, age-verification, labeling, delivery, and recordkeeping requirements.

At launch, Dirty Penny offers vape / ENDS products only within Florida and does not offer interstate direct-to-consumer shipment of vape / ENDS products.

To the extent Dirty Penny sells, transfers, or ships ENDS products in interstate commerce, Dirty Penny is required to register with the Bureau of Alcohol, Tobacco, Firearms and Explosives (“ATF”) and with the tobacco tax administrator of each state or locality receiving shipments, and to comply with all applicable PACT Act registration, reporting, tax, licensing, age-verification, delivery, labeling, and recordkeeping requirements.

Dirty Penny does not ship vape or ENDS products through USPS. USPS is prohibited from accepting or delivering ENDS products to consumers under federal law.

Within Florida, vape or ENDS products may be made available only through compliant local delivery, pickup, or compliant private delivery channels where available, lawful, and operationally supported.

Dirty Penny reserves the right to restrict vape products to Florida, restrict vape products to local delivery, restrict vape products to in-person pickup where lawful, disable vape checkout, cancel vape orders, or discontinue vape products entirely if compliance cannot be maintained.

If Dirty Penny later offers interstate ENDS shipping, Dirty Penny will do so only after applicable PACT Act registration, state or local tobacco tax administrator registration, reporting, recordkeeping, adult-signature delivery, tax, licensing, and carrier requirements are satisfied.

Nothing on this website guarantees that vape or inhalable products are available for direct-to-consumer shipping.

17. Returns, Refunds, and Exchanges

Returns, refunds, and exchanges are governed by Dirty Penny’s Return & Refund Policy, which is incorporated into these Terms by reference.

Claims for damaged, defective, leaking, broken, tampered-with, expired, or incorrect items must be submitted within 72 hours after delivery, or within 72 hours after the customer has had a reasonable opportunity to inspect the item.

Missing-package claims must be submitted within 5 business days after the carrier marks the package delivered.

Because many Dirty Penny products may be consumable, ingestible, inhalable, sealed, regulated, perishable, age-restricted, or adult-use products, Dirty Penny may be unable to accept returns once products have been shipped, opened, used, tampered with, damaged, unsealed, removed from original packaging, stored improperly, or transferred from the original purchaser, except where Dirty Penny determines that the claim meets the eligibility criteria in the Return & Refund Policy.

Dirty Penny reserves the right to refuse returns or refunds where fraud, misuse, product tampering, policy abuse, legal restrictions, safety concerns, chargeback abuse, or compliance concerns are present.

18. Product Recalls and Safety Notices

Dirty Penny may issue product notices, manufacturer updates, safety communications, recall information, or compliance notices when appropriate.

You agree to review all product packaging, warnings, labels, certificates of analysis, serving information, safety information, and manufacturer instructions before using any product.

If you believe a product is defective, mislabeled, contaminated, damaged, expired, unsafe, or inconsistent with the product ordered, stop using it immediately and contact Dirty Penny through the contact method listed on our website or order confirmation.

19. No Resale or Redistribution

Products purchased from Dirty Penny are for lawful personal use only unless Dirty Penny provides written authorization otherwise.

You may not resell, redistribute, export, transfer, repackage, relabel, alter, modify, counterfeit, or commercially exploit any Dirty Penny product.

You may not provide Dirty Penny products to minors, prohibited persons, intoxicated persons, or persons located in jurisdictions where the product is unlawful.
