1. Definitions

"Business days" means Monday through Friday, excluding United States federal holidays.

"Delivery" means the date the carrier records the package as delivered, or the date of handoff for local delivery or in-person pickup.

"ENDS" means an electronic nicotine delivery system, and includes vapes, cartridges, pods, e-liquids, and related components, parts, and accessories, as defined under applicable federal law.

"Fulfillment" means the point at which a processed order is packed and released to a carrier or delivery channel.

2. Age-Restricted Shipping

Dirty Penny products are intended for adults aged 21 years or older.

Orders for hemp, THC, vape, or other age-restricted products require age verification and adult-signature delivery unless Dirty Penny expressly states otherwise.

Orders may require:

Dirty Penny uses AgeChecker, or another age-verification provider of its choosing, and reserves the right to cancel or refuse any order where age, identity, address, payment, shipping, or compliance requirements cannot be verified.

3. Shipping Eligibility

Shipping eligibility depends on product type, customer location, state law, federal law, local law, carrier availability, payment-processor rules, supplier requirements, and Dirty Penny compliance policies.

Not all products are available for shipment to all locations. Eligibility is determined by product type as well as destination, so two items in the same order may not be eligible for the same address.

Hemp-derived THC products, including THC beverages, Delta-9 products, flower, pre-rolls, and edibles, may ship outside Florida only where legally permitted and only after Dirty Penny determines that the destination, product type, carrier, age-verification process, and compliance requirements are acceptable.

Dirty Penny ships within Florida and to other states where the relevant product category is lawfully permitted and operationally supported.

Dirty Penny does not currently ship to Alaska, Hawaii, Idaho, Utah, New York, or Rhode Island.

Because state hemp and cannabinoid laws change frequently, the list of supported destinations is reviewed on an ongoing basis and may change without notice. The eligibility check applied at checkout is authoritative and takes precedence over any list published elsewhere on the website.

5. Customer Responsibility

By placing an order, you confirm that:

• You are at least 21 years old
• You are legally permitted to purchase and receive the ordered products
• You have reviewed the laws applicable to your purchase, possession, and receipt of the ordered products in your jurisdiction
• The shipping address is accurate and deliverable
• You will not provide products to minors
• You will not resell or redistribute products

• You understand that hemp-derived THC beverages, Delta-9 products, flower, pre-rolls, edibles, and similar products may be cancelled if the destination is not legally or operationally supported

6. Order Processing

Orders are processed only after payment, age verification, inventory review, and compliance checks are completed.

Orders are generally processed within 1 business day. Processing times may vary due to:

• Fraud-prevention review

• Compliance restrictions
• Carrier availability

An order confirmation does not guarantee that an order has been accepted for fulfillment.

7. Shipping Times and Tracking

Shipping times shown at checkout are estimates only and are not guarantees.

For in-stock orders shipped within Florida after fulfillment, delivery typically takes 2 to 7 business days depending on carrier, destination, product type, adult-signature requirements, and compliance review.

Out-of-state orders generally take longer and vary by destination and carrier. The carrier estimate shown at checkout is the best available guide for a given address.

Tracking information is provided by email once an order ships. Tracking updates are generated by the carrier and Dirty Penny does not control their timing or accuracy.

Dirty Penny is not responsible for delays caused by:

• Weather

• Failed adult signature
• Incorrect addresses
• Payment review
• Product availability

8. Split and Partial Shipments

Where an order contains items with different shipping eligibility, carrier requirements, or availability, Dirty Penny may ship the order in more than one package, ship eligible items and cancel ineligible items, or hold the order until it can be shipped together.

Where part of an order is cancelled for eligibility reasons, Dirty Penny will refund the cancelled portion in accordance with the Return & Refund Policy. Additional shipping charges are not applied to split shipments made at Dirty Penny's election.

9. Adult Signature, Local Delivery, and Delivery Requirements

Orders containing hemp, THC, vape, or other age-restricted products require adult signature unless Dirty Penny expressly states otherwise.

An adult signature means signature by a person aged 21 or over who can present valid government-issued photo identification at the point of delivery. Packages cannot be released without one, and instructions to leave a package unattended cannot be honored on age-restricted orders.

Some orders may also require proof of age, AgeChecker verification, ID verification, or restricted delivery.

If a delivery cannot be completed because an eligible adult is unavailable, ID cannot be verified, the package is refused, or the carrier cannot complete delivery, the order may be returned, cancelled, delayed, or subject to additional charges.

For local delivery orders, customers should inspect the package at the time of handoff where possible and report any visible damage, incorrect item, or safety concern to Dirty Penny immediately.

Shipping charges, adult-signature fees, carrier fees, return fees, and compliance fees may be non-refundable where permitted by law and as described in Dirty Penny's Return & Refund Policy.

10. Incorrect, Incomplete, or Undeliverable Addresses

You are responsible for providing a complete and accurate shipping address.

Dirty Penny is not responsible for orders that are delayed, lost, misdelivered, returned, or undeliverable because of:

• Incorrect address
• Missing apartment, unit, or suite number
• Wrong ZIP code
• Use of a freight forwarder
• Use of a mail-forwarding service
• Use of a temporary address
• Carrier inability to access the location
• Refusal of delivery
• Failure to complete adult-signature or age-verification requirements

Dirty Penny does not ship age-restricted products to PO Boxes, because adult-signature delivery cannot be completed at them.

Dirty Penny may refuse shipment to freight-forwarding, mail-forwarding, hotel, temporary, high-risk, or suspicious addresses.

11. Lost, Stolen, Damaged, or Tampered Packages

If a package is lost, stolen, delayed, damaged, or marked delivered but not received, contact Dirty Penny within the applicable claim window.

Customers should inspect packages immediately upon delivery.

Damaged, defective, leaking, broken, contaminated, expired, incorrect, or tampered-with product claims should be submitted within 72 hours after delivery, or within 72 hours after the customer has had a reasonable opportunity to inspect the item.

Missing-package claims should be submitted within 5 business days after the carrier marks the package delivered.

Dirty Penny may assist with carrier investigation where available, but does not guarantee replacement, refund, or store credit for packages affected by carrier error, theft, incorrect address, failed delivery, weather, or events outside Dirty Penny's reasonable control.

Risk of loss or damage generally transfers to you upon delivery to the shipping address provided, subject to applicable law. For local delivery and in-person pickup orders, risk transfers at the point of handoff.

Dirty Penny is not responsible for loss, theft, or damage that occurs after delivery is confirmed by the carrier.

12. Restricted Products

Depending on destination, carrier, and applicable law, the following may be restricted or unavailable for shipment, including but not limited to:

• Hemp-derived THC products, including THC beverages, Delta-9 products, flower, pre-rolls, and edibles
• THCA products
• Delta-8 THC products
• HHC products
• Vape products
• Inhalable products
• Beverages
• Edibles
• Products subject to state-specific cannabinoid rules
• Products affected by carrier or payment-processor restrictions

Inclusion in this list does not mean a product is unavailable everywhere. It means availability depends on the destination and the conditions described in this Policy.

Dirty Penny may change shipping availability at any time in response to legal, regulatory, carrier, supplier, payment-processor, insurance, or operational requirements.

13. Vape, ENDS, and Inhalable Product Shipping

Vape, ENDS, hemp vape, cannabinoid vape, disposable vape, cartridge, pod, e-liquid, component, part, accessory, and related inhalable products are subject to strict federal, state, local, carrier, registration, reporting, tax, age-verification, labeling, and delivery requirements.

Dirty Penny does not ship vape or ENDS products through USPS.

USPS is prohibited from accepting or delivering ENDS products to consumers under federal law.

To the extent Dirty Penny sells, transfers, or ships ENDS products in interstate commerce, Dirty Penny is required to register with the ATF and with the tobacco tax administrator of each state or locality receiving shipments, and to comply with applicable PACT Act registration, reporting, tax, licensing, delivery, labeling, age-verification, and recordkeeping requirements.

Vape and ENDS products are currently available only within Florida and are not offered for interstate direct-to-consumer shipment.

Vape or ENDS products may be unavailable for shipping and may be restricted to compliant Florida local delivery, pickup, or compliant private delivery channels where lawful and operationally supported.

Dirty Penny may restrict vape products to Florida, local delivery, in-person pickup where lawful, or may discontinue vape sales entirely if compliance cannot be maintained.

If Dirty Penny later offers interstate ENDS shipping, Dirty Penny will do so only after applicable PACT Act registration, state or local tobacco tax administrator registration, reporting, recordkeeping, adult-signature delivery, tax, licensing, and carrier requirements are satisfied.

14. No International Shipping

Dirty Penny does not ship hemp, CBD, THC, vape, inhalable, cannabis-related, or restricted adult-use products internationally.

Dirty Penny also reserves the right to refuse orders to APO, FPO, DPO, freight-forwarding, mail-forwarding, hotel, temporary, commercial, or high-risk addresses.

15. State and Federal Law Changes

Federal and state hemp laws are subject to frequent and significant change.

Dirty Penny reserves the right to immediately suspend, restrict, cancel, or discontinue shipping of any product or category if legal, regulatory, payment, supplier, or carrier conditions change.

This may include restrictions affecting hemp-derived THC products, THCA products, Delta-8 products, Delta-9 products, HHC products, beverages, edibles, vapes, inhalables, and similar products.

16. Shipping Charges

Shipping charges are calculated and displayed at checkout before order confirmation.

Shipping is free on orders over $75, unless otherwise stated at checkout. Free-shipping thresholds may exclude certain products, destinations, or delivery methods, and may be varied or withdrawn at any time.

Shipping charges may vary based on:

Dirty Penny may cancel, refuse, modify, or hold any order where shipping, payment, age verification, identity verification, legal compliance, product availability, or fraud-prevention requirements cannot be satisfied.

If an order is cancelled after payment has been processed, Dirty Penny will issue a refund for the cancelled portion of the order, subject to applicable law, payment-processor rules, and any non-refundable fees.

Refunds for cancelled orders will generally be initiated within 7 business days after cancellation approval, subject to payment-processor rules and financial-institution processing times.

Changes take effect when posted on the website unless otherwise stated. The version in effect at the time an order is placed governs that order.

Nothing in this Shipping Policy is intended to limit or exclude any right or remedy a customer has under applicable consumer-protection law that cannot lawfully be limited or excluded.

If any provision of this Shipping Policy is found to be unenforceable, that provision will be modified or severed to the minimum extent necessary, and the remaining provisions will continue in full force.

Dirty Penny's failure to enforce any provision of this Shipping Policy is not a waiver of that provision.

This Shipping Policy is governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles.
